TERMS AND CONDITIONS

Minimum age

The minimum age for subscribing to any Every Move Academy Program is 18yrs.

Your Health

You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do any form of active exercise, including, but not limited to, High Intensity Interval training, strength training or cardiovascular training.

Acknowledgement of Risks

You warrant that you are aware that all exercise carries risks, and acknowledge you are participating willingly, and in knowledge of these risks.

You recognise that we are not able to provide you with medical advice, and that any information provided should be used as a guideline only. If you have any prior knowledge of health concerns or health risks, you acknowledge that it is your responsibility to seek clearance from a health care professional prior to signing up to any Every Move Academy program.

Indemnity

You agree to fully indemnify without limitation any trainer(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for Every Move Academy.

Subscription Policy

Every Move Academy programs are monthly subscriptions (with the exclusion of Project Athletic) and therefore we have the rights to charge an ongoing monthly payment, unless notified by you (the customer) to cancel.

Cancelations require a 1 month written notice for all subscriptions.

All Every Move Academy subscriptions have a minimum term of 3 months (12 weeks). No refunds.

You agree to ensure your bank account can make credit / debit card payments and will have sufficient funds available to on or before your payment due date. Every Move Academy serve the right to manually change to the funds, should a payment fail or not be met for your subscription.

You agree to ensure that your payment method on file remains valid with at least 1 months validity at present. Should you lose, damage or need to update your card details, this must be be organised with your Every Move Academy coach.

If your chosen payment method fails, you are liable for any and all resulting fees.

If you do not fully pay your fees on the due date, Every Move Academy has the right to suspend or decline access to any services, activities and facilities associated with Every Move Academy until any outstanding balances have been paid in full.

You understand and acknowledge that we will continue to debit your nominated account without notice, until we have received the total amount you owe the company.

FIT IN TWELVE

You agree that Every Move Academy's 12 week program, FIT IN TWELVE is subject to a single payment for 12 weeks that is non refundable. In the event of injury before the start date, the program can be transferred or postponed to an alternative date, no refunds are permitted. Payment must be made in full before the start date.

Money Back Guarantee

Our money back guarantee is only valid on our 12 week program FIT IN TWELVE subject to the client completing all aspects of the program as prescribed, nutrition monitored daily as advised and changes applied when instructed by their coach. Money back guarantee cannot be granted for any client who does not complete every as every aspect of the program.

Cancelation Policy

It is your responsibility to read and understand our cancellation policy before starting a subscription. All Every Move Academy subscriptions require a 1 month minimum notice to cancel. Cancelations should be made in writing to your Every Move Academy coach. Payment for your last month is required and Every Move Academy have the right to charge for the funds owed in the event of any failed payments.

Under no circumstances are subscriptions refundable.

You agree that your exercise sessions are your own responsibility. Every Move Academy take no responsibility for injury or liability. Every Move Academy are unable to offer refunds as a result of injury.

Rights to Pause

Every Move Academy subscriptions can be paused for a minimum of 1 month and a maximum of 6 months. You agree to make your Every Move Academy coach aware of your returning start date and agree for the payment to be made on such start date. Subscriptions cannot be paused for short term periods such as holidays, short term injuries or convenience.

PAR-Q

You agree to sign a Physical Activity Readiness form with Every Move Academy before your subscription start date.

You acknowledge that during any activities hosted by Every Move Academy, that you participate voluntarily in all activities, and insofar as is legally permissible, you surrender your right to any cause of action against Every Move Academy, their agents, contractor’s, employee’s and directors, arising from any loss or damage to any person or property that occurs during Every Move Academy up to and including death.

This agreement, and any dispute, or claim of whatever nature arising out of or in any way relating to this policy agreement or its formation, shall be governed by and construed in accordance with English law.

Photo / Video Release – Use of Image

Our Service allows you to post, link, store, share and otherwise make

available certain information, text, graphics, videos, or other material

(“Content”). You are responsible for the Content that you post to the Service,

including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use,

modify, perform, display, reproduce, and distribute such Content on and

through the Service. You retain any and all of your rights to any Content you

submit, post or display on or through the Service and you are responsible for

protecting those rights.

You represent and warrant that: (i) the Content is yours (you own it) or you

have the right to use it and grant us the rights and license as provided in these

Terms, and (ii) the posting of your Content on or through the Service does not

violate the privacy rights, publicity rights, copyrights, contract rights or any

other rights of any person.

Account

When you create an account with us, you must provide us information that is

accurate, complete, and current at all times. Failure to do so constitutes a

breach of the Terms, which may result in immediate termination of your

account on our Service.

You are responsible for safeguarding the password that you use to access the

Service and for any activities or actions under your password, whether your

password is with our Service or a third-party service.

You must not share this confidential information with any other third party in

order to avoid unauthorised use of your data.

You agree not to disclose your password to any third party. You must notify us

immediately upon becoming aware of any breach of security or unauthorised

use of your account.

You may not use as a username the name of another person or entity or that

is not lawfully available for use, a name or trade mark that is subject to any

rights of another person or entity other than you without appropriate

authorization, or a name that is otherwise offensive, vulgar or obscene. You

expressly agree that we cannot be held liable for any loss or damage arising

out of any misrepresentations you make in this regard.

Intellectual Property

The Service and its original content (excluding Content provided by users),

features and functionality are and will remain the exclusive property of Every

Move Academy and its licensors. The Service is protected by copyright,

trademark, and other laws of both the United Kingdom and foreign countries.

Our trademarks and trade dress may not be used in connection with any

product or service without the prior written consent of Every Move Academy.

When you upload content, you give Every Move Academy a worldwide,

non-exclusive, royalty-free, transferable licence (with right to sub-licence) to

use, reproduce, distribute, prepare derivative works of, display, and perform

that Content in connection with the provision of the Service and otherwise in

connection with the provision of the Service and Every Move Academy

business.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not

owned or controlled by Every Move Academy.

Every Move Academy has no control over, and assumes no

responsibility for, the content, privacy policies, or practices of any third party

web sites or services. You further acknowledge and agree that Every Move

Academy shall not be responsible or liable, directly or indirectly, for any

damage or loss caused or alleged to be caused by or in connection with use

of or reliance on any such content, goods or services available on or through

any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies

of any third-party web sites or services that you visit.

Health and medical Conditions

You acknowledge and represent that:

1) to the best of your knowledge, you suffer from no medical or physical

condition or disability that will or might increase the normal risks associated

with exercise; and

2) if you do suffer from a medical or physical condition or disability, your doctor

has approved your participation in exercise.

You must inform us, as soon as possible, if:

(i) you suffer from any new injury, illness or other medical condition;

(ii) you have a change in circumstances which may reflect your ability to

exercise.

(iii) you feel that any exercise would be unsafe or uncomfortable for you.

Limitation Of Liability

In no event shall Every Move Academy, nor its directors, employees,

partners, agents, suppliers, or affiliates, be liable for any indirect, incidental,

special, consequential or punitive damages, including without limitation, loss

of profits, data, use, goodwill, or other intangible losses, resulting from (i) your

access to or use of or inability to access or use the Service; (ii) any conduct or

content of any third party on the Service; (iii) any content obtained from the

Service; and (iv) unauthorized access, use or alteration of your transmissions

or content, whether based on warranty, contract, tort (including negligence) or

any other legal theory, whether or not we have been informed of the possibility

of such damage, and even if a remedy set forth herein is found to have failed

of its essential purpose.
